Elbows Linked (“Elbows Linked,” “we,” “us,” or “our”) respects your privacy and is committed to protecting the personal information entrusted to us.

This Privacy Policy explains how Elbows Linked collects, uses, discloses, stores, safeguards, and disposes of personal information in connection with our organization, programs, events, communications, and projects, including The Great Canadian 160 Playlist.

This Privacy Policy is intended to comply with Alberta’s Personal Information Protection Act (PIPA) and its regulations, as applicable to Elbows Linked.

1. Our Responsibility

Elbows Linked is responsible for the personal information in its custody or control.

We have designated a person responsible for ensuring that our organization complies with PIPA and for responding to privacy-related questions, requests, and complaints.

2. What Is Personal Information?

For the purposes of this Policy, personal information means information about an identifiable individual.

Depending on how you interact with Elbows Linked, we may collect information such as:

  • Full name;

  • Artist or professional name;

  • Email address;

  • Telephone number;

  • Mailing address;

  • City, province, or country;

  • Organization or business name;

  • Website address;

  • Social media information;

  • Artist biography;

  • Photograph;

  • Information about your participation in our programs or projects;

  • Song titles;

  • Songwriter and composer information;

  • Links to music recordings and related materials;

  • Correspondence with Elbows Linked;

  • Information you provide through forms or applications; and

  • Other information reasonably necessary to administer a project or activity.

We will not ask for personal information that is unnecessary for the purposes for which it is being collected.

3. The Great Canadian Playlist

The Great Canadian 160 Playlist is a project of Elbows Linked intended to create a digital collection of Canadian musical perspectives in connection with Canada 160 celebrations in July 2027.

Information collected for The Great Canadian 160 Playlist may be used to:

  • Register and identify participating artists and songwriters;

  • Communicate with contributors;

  • Administer song submissions;

  • Verify information relating to submissions;

  • Organize and maintain the project database;

  • Create and administer the digital playlist or collection;

  • Identify artists and songs publicly;

  • Promote participating artists and the project;

  • Provide selected information to media organizations;

  • Facilitate potential radio, television, online, performance, or other media opportunities;

  • Coordinate Canada 160-related activities;

  • Contact contributors regarding project updates and opportunities; and

  • Maintain appropriate records relating to the project.

The information collected will be limited to what is reasonably required for these purposes.

4. How We Collect Personal Information

Where reasonable and appropriate, we collect personal information directly from the individual to whom it relates.

This may occur when you:

  • Complete our Artist Submission Form;

  • Submit a song or recording;

  • Register for a project or event;

  • Contact us by email;

  • Contact us through our website or social media;

  • Participate in a survey;

  • Provide information for promotional purposes; or

  • Otherwise voluntarily provide information to Elbows Linked.

In certain circumstances, we may collect information from another source where permitted by PIPA, including where you have consented or where the law authorizes the collection.

5. Notice at the Time of Collection

Before or at the time we collect personal information, we will make reasonable efforts to inform you of:

  1. The purpose for which the information is being collected;

  2. The ways in which the information may be used or disclosed; and

  3. The name or title and contact information of a person who can answer questions about the collection.

6. Consent

Generally, Elbows Linked will obtain consent before collecting, using, or disclosing personal information.

Consent may be provided in writing, electronically, verbally, or through another form permitted by PIPA.

For example, consent may be provided by checking a box on the Artist Submission Form confirming that you agree to the applicable Privacy Policy and Terms & Conditions.

We may rely on implied consent where PIPA permits it and where the circumstances reasonably support that conclusion.

We will generally seek express consent where information is sensitive or where the collection, use, or disclosure would not reasonably be expected by the individual.

You may withdraw your consent to future collection, use, or disclosure of your personal information by contacting our Privacy Officer.

Withdrawal of consent may affect our ability to administer your participation in a project or provide certain services.

7. How We Use Personal Information

We will use personal information only for the purposes for which it was collected, for purposes that are consistent with those purposes, or where another legal basis under PIPA permits the use.

For example, information collected through The Great Canadian 160 Playlist submission form may be used to:

  • Contact you about your submission;

  • Confirm information about your song;

  • Include your song in the project;

  • Identify you as a participating artist or songwriter;

  • Promote the playlist and participating contributors;

  • Communicate with media and project partners;

  • Coordinate performances or other Canada 160 activities; and

  • Provide you with relevant project updates.

We will not use your personal information for unrelated purposes without obtaining additional consent where required.

8. Public Information and Artist Promotion

If you voluntarily submit information specifically identified as public or promotional information, such as:

  • Artist name;

  • Song title;

  • Artist biography;

  • Photograph;

  • Website;

  • Social media links; or

  • Other promotional information,

you authorize Elbows Linked to use that information for the purposes identified in the submission process.

This may include publication or distribution through:

  • The Great Canadian 160 Playlist;

  • Elbows Linked websites;

  • Social media;

  • News releases;

  • Promotional materials;

  • Media packages;

  • Radio or television opportunities;

  • Online media;

  • Presentations;

  • Performances;

  • Canada 160-related activities; and

  • Communications with authorized project partners.

Private contact information, such as your personal email address or telephone number, will not be publicly displayed simply because you submit it to us.

9. Sharing Information With Media and Project Partners

The Great Canadian 160 Playlist may involve working with media organizations, broadcasters, event organizers, arts organizations, Canada 160 partners, and other organizations involved in promoting or delivering the project.

Where you have provided appropriate consent, we may disclose selected information about participating artists for purposes such as:

  • Media coverage;

  • Radio or television programming;

  • Interviews;

  • Playlist promotion;

  • Performances;

  • Canada 160 celebrations;

  • Artist discovery;

  • Publicity; and

  • Other opportunities directly related to the project.

We will limit the information disclosed to what is reasonably appropriate for the relevant purpose.

We will not sell your personal information.

We will not provide your personal contact information to third parties for their unrelated marketing purposes without appropriate consent or another lawful basis.

10. Google Forms, Google Sheets and Google Workspace

Elbows Linked may use Google Forms, Google Sheets, Google Drive, Gmail, and other Google Workspace services to collect, manage, store, organize, and communicate information.

For example, information submitted on the Artist Submission Form may be automatically entered into a Google Sheet that serves as a project database.

Access to these systems will be restricted to authorized individuals who require access for legitimate Elbows Linked purposes.

We will take reasonable steps to ensure that personal information stored in these systems is protected against unauthorized access, use, disclosure, copying, modification, disposal, or destruction.

11. Service Providers Outside Canada

Some of the technology and service providers we use may operate or process information outside Canada.

For example, Google is a U.S.-based company and Google Workspace services may involve the processing, storage, or access to information in jurisdictions outside Canada.

Where required by Alberta PIPA, Elbows Linked will provide information about:

  • The countries in which personal information may be processed, stored, or accessed by a service provider;

  • The purposes for which the service provider is authorized to collect, use, disclose, or otherwise handle personal information;

  • How you may obtain information about our policies and practices regarding service providers outside Canada; and

  • Who within Elbows Linked can answer questions about those practices.

The use of an outside service provider does not change Elbows Linked’s responsibility for protecting personal information in accordance with applicable law.

12. Who May Access Personal Information

Access to personal information is limited to individuals who reasonably need the information to perform their responsibilities.

Depending on the circumstances, this may include:

  • Elbows Linked staff;

  • Authorized project coordinators;

  • Authorized volunteers;

  • Contractors or service providers;

  • Technology service providers;

  • Communications or marketing providers;

  • Authorized project partners; and

  • Other parties where disclosure is authorized by you or permitted or required by law.

13. Limiting Collection

We will collect only the personal information that is reasonably required for the purposes identified in this Policy or otherwise permitted by law.

We will not collect personal information simply because it might be useful at some future time.

14. Accuracy of Personal Information

We will make reasonable efforts to ensure that personal information is accurate and complete enough for the purposes for which it is being used.

You may request correction of inaccurate or incomplete personal information.

If you become aware that information you have provided to us has changed, we encourage you to contact us so that our records can be updated.

15. Security Safeguards

Elbows Linked will use reasonable safeguards appropriate to the sensitivity of the information we hold.

These safeguards may include:

  • Password protection;

  • Restricted database access;

  • Account security measures;

  • Limiting access to authorized individuals;

  • Confidentiality obligations;

  • Secure electronic systems;

  • Administrative procedures;

  • Regular review of access permissions; and

  • Procedures for responding to privacy incidents.

No electronic system can be guaranteed to be completely secure.

However, we will take reasonable measures to protect personal information against unauthorized access, collection, use, disclosure, copying, modification, disposal, or destruction.

16. Privacy Breaches

A privacy breach may occur if personal information is lost or if someone accesses or discloses personal information without authorization.

If Elbows Linked becomes aware of a privacy breach, we will take reasonable steps to:

  1. Contain the breach;

  2. Determine what information was affected;

  3. Assess the potential risk of harm;

  4. Notify affected individuals where required;

  5. Notify the Office of the Information and Privacy Commissioner of Alberta where required;

  6. Take steps to reduce potential harm; and

  7. Review and improve our safeguards and procedures where appropriate.

17. Retention and Destruction

We will retain personal information only for as long as reasonably necessary to:

  • Fulfill the purpose for which it was collected;

  • Administer The Great Canadian 160 Playlist or another project;

  • Maintain appropriate organizational records;

  • Meet legal, accounting, contractual, or other legitimate requirements; or

  • Establish, exercise, or defend legal rights.

When personal information is no longer required, we will take reasonable steps to securely destroy, erase, or anonymize it.

18. Your Right to Access Your Personal Information

Under Alberta PIPA, you may make a written request for access to your personal information held by Elbows Linked.

You may also request information about:

  • The existence of your personal information;

  • How your personal information has been used; and

  • To whom your personal information has been disclosed, where applicable.

We will respond to access requests in accordance with the requirements and timelines established by PIPA.

Certain exceptions to access may apply under the Act.

19. Correcting Your Information

If you believe that personal information we hold about you is inaccurate or incomplete, you may make a written request that we correct the information.

We will review the request and, where appropriate, correct the information in accordance with PIPA.

Where we are unable to make a requested correction, we will explain the reason and, where appropriate, record that a correction was requested.

20. Withdrawing Consent

You may withdraw consent to future collection, use, or disclosure of your personal information by contacting our Privacy Officer.

Your request should identify, where possible, the information and the purposes for which you are withdrawing consent.

Withdrawal of consent does not affect any collection, use, or disclosure that occurred before your withdrawal.

There may also be circumstances where Elbows Linked is permitted or required by law to retain or use information despite a withdrawal of consent.

If you have a question or concern about our handling of your personal information, please contact our Privacy Officer first.

We will review your concern and make reasonable efforts to resolve it.

22. Children’s Personal Information

The Great Canadian 160 Playlist and our other projects are generally intended for adults.

If a submission involves an individual who is a minor, we may require additional consent or authorization from a parent or legal guardian where appropriate or required by law.

We will take reasonable steps to ensure that personal information relating to minors is handled appropriately.

23. Creative Works and Copyright

This Privacy Policy concerns personal information and does not transfer ownership of copyright or other intellectual property.

Submitting a song, composition, recording, photograph, biography, or other creative material does not, by itself, transfer ownership of that material to Elbows Linked.

Any permissions concerning the use, reproduction, publication, distribution, performance, or promotion of creative works are governed by the applicable Terms & Conditions, submission agreement, or other agreement associated with the project.

24. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect:

  • Changes to our programs or activities;

  • Changes to our use of technology;

  • Changes to our privacy practices;

  • Changes to applicable legislation; or

  • Recommendations or guidance from privacy regulators.

The current version will be made available through our website or other appropriate means.

The effective date at the beginning of the Policy indicates when the current version came into effect.
