Terms & Conditions

These Terms & Conditions (“Terms”) govern your participation in projects, programs, submissions, and activities administered by Elbows Linked (“Elbows Linked,” “we,” “us,” or “our”), including The Great Canadian Playlist.

By submitting information, registering for an activity, or participating in one of our projects, you agree to these Terms.

1. Eligibility

Participation is open to individuals who meet the eligibility requirements communicated for the specific project or initiative.

For The Great Canadian 160 Playlist, submissions are intended for Canadian songwriters, composers, artists, and/or rights holders as specified in the applicable submission guidelines.

We reserve the right to determine eligibility and to decline or remove a submission that does not comply with Elbows Linked guidelines and values.  

2. Submission of Information and Materials

When you submit information or materials to us, you confirm that the information you provide is accurate and that you have the authority to provide it.

Depending on the project, submitted materials may include:

  • Your name and contact information;

  • Artist, songwriter, composer, or organization information;

  • Song titles and recordings;

  • Lyrics or other creative materials;

  • Artist biographies and photographs;

  • Website and social media information; and

  • Other information requested as part of the submission process.

You are responsible for ensuring that your submission does not contain material that you do not have the right to provide.

3. Ownership of Your Creative Work

You retain ownership of your original creative work.

Submitting a link (song, composition, recording), photograph, biography, or other material to Elbows Linked does not transfer ownership or copyright to Elbows Linked.

You remain responsible for ensuring that you own, control, or have obtained all necessary rights and permissions relating to the material you submit.

4. Permission to Use Submitted Materials

By submitting material to a project, you grant Elbows Linked the permissions reasonably necessary to administer, promote, and deliver that project, subject to any specific terms communicated at the time of submission.

For The Great Canadian 160 Playlist, this may include permission to:

  • Include the submitted song in the playlist or digital collection;

  • Make the song available to media and other authorized project partners;

  • Promote the project and participating artists;

  • Identify the artist, songwriter, composer, or contributor by name;

  • Use submitted artist biographies, photographs, website links, and related promotional information;

  • Include selected submissions in presentations, performances, broadcasts, social media, websites, promotional materials, or Canada 160-related activities; and

  • Create reasonable promotional materials featuring the submitted contribution.

We will not claim ownership of your copyright simply because you have submitted your work.

Where a particular use requires rights beyond those granted through these Terms, we will seek additional permission or enter into a separate agreement where appropriate.

5. Rights and Clearances

By submitting a work, you represent and warrant that:

  • You own or control the rights necessary to submit the work;

  • You have obtained any required permissions from co-writers, performers, producers, labels, publishers, or other rights holders;

  • The submission does not knowingly infringe the copyright, trademark, privacy, publicity, or other rights of another person or organization; and

  • You have the authority to grant the permissions described in these Terms.

If a work has multiple rights holders, you are responsible for obtaining the necessary authorization from those rights holders.

Elbows Linked is not responsible for disputes between contributors and other rights holders.

6. Royalties and Compensation

Unless expressly stated otherwise in writing, participation in a project does not create an entitlement to payment, royalties, licensing fees, or other compensation.

Participants remain responsible for any arrangements they have with publishers, labels, collecting societies, distributors, co-writers, or other rights holders.

7. Selection and Inclusion

Submission does not guarantee inclusion in a playlist, event, performance, publication, broadcast, media opportunity, or other project activity.

Elbows Linked may review submissions and determine which materials are included or featured.

We may also remove or decline a submission if we believe it does not meet the project’s eligibility, technical, legal, or content requirements.

8. Publicity

By participating, you acknowledge that your name, artist name, organization name, and information that you have specifically provided for promotional purposes may be used to promote the project.

If you provide a photograph, biography, website, social media information, or similar promotional material, you confirm that you have permission for us to use it for the purposes described in these Terms.

9. Accuracy of Information

You agree to provide accurate, current, and complete information.

If information changes after submission, please notify us so that we can update our records where reasonably possible.

10. Privacy

Personal information collected through our forms, databases, and other systems will be handled in accordance with our Privacy Policy.

Personal information will be used only for legitimate organizational, administrative, communications, and project-related purposes as described in the Privacy Policy.

11. Third-Party Services

We may use third-party services, including Google Forms, Google Sheets, Google Drive, email platforms, playlist platforms, websites, and other technology providers to administer our projects.

Your use of or interaction with those services may also be subject to the terms and privacy policies of those third parties.

12. Prohibited Content

We reserve the right to reject or remove submissions that contain unlawful, defamatory, fraudulent, abusive, discriminatory, or otherwise inappropriate material, or material that violates the rights of others.

This does not prevent the submission of creative works that address challenging, controversial, political, social, or cultural subjects, provided the submission otherwise complies with applicable requirements.

13. Changes or Cancellation

We reserve the right to modify, suspend, postpone, or cancel a project, playlist, event, submission period, or related activity where reasonably necessary.

We will make reasonable efforts to communicate significant changes to participants.

14. Limitation of Liability

To the extent permitted by applicable law, Elbows Linked will not be responsible for losses arising from circumstances beyond our reasonable control, including technical failures, internet or platform outages, unauthorized access, third-party service interruptions, or loss of submitted information.

Nothing in these Terms is intended to exclude or limit any liability that cannot legally be excluded or limited.

15. No Guarantee of Promotion or Exposure

Participation in a project does not guarantee that a submission will receive media coverage, playlist placement, radio play, performance opportunities, social media exposure, or other promotional opportunities.

Any such opportunities are subject to availability and the decisions of Elbows Linked, media organizations, event organizers, broadcasters, platforms, and other third parties.

16. Intellectual Property

All original materials created by Elbows Linked in connection with its projects—including branding, logos, website content, graphics, promotional materials, and original written content—remain the property of Elbows Linked or its respective licensors unless otherwise stated.

You may not reproduce, modify, distribute, or commercially exploit those materials without permission.

17. Governing Law

These Terms are governed by the laws applicable in the jurisdiction in which Elbows Linked operates, without regard to conflict-of-law principles.

Any dispute will be subject to the applicable courts and legal processes of that jurisdiction.

18. Changes to These Terms

We may update these Terms from time to time.

The most current version will be made available to participants, and the effective date will be updated when material changes are made.

20. Agreement

By checking the applicable consent box, submitting a form, or otherwise participating in a project, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
